FAIS Labs Terms of Service

1. Regulatory Disclaimer & Nature of Service

FAIS Labs is a private, independent educational technology platform.

• No official affiliation: FAIS Labs is not affiliated with, endorsed by, or partnered with the Financial Sector Conduct Authority (FSCA) or any official regulatory testing body.
• No pass guarantee: Our question banks, topic sprints, and mock papers are structured for training and self-assessment purposes only. While our platform mirrors the official 8-task FSCA regulatory framework, completion of our materials does not guarantee a passing mark on the official regulatory examination.
• Not financial or legal advice: Content provided within our platform represents educational training data and does not constitute formal legal, compliance, or financial advice.

2. Account Registration and Security

To utilise our mock papers and tracking modules, you must register a user account.

• Accuracy of information: You agree to provide true, accurate, and current information during registration and keep your profile metrics up to date.
• Credential protection: You are entirely responsible for maintaining the confidentiality of your account password. Your password is encrypted via secure server-side hashing parameters.
• Account exclusivity: Your account is strictly personal and non-transferable. You may not share your login credentials, transfer your dashboard tracking to another individual, or allow third parties to log into your testing interface. Simultaneous multi-device logins under a single profile are systemically blocked.

3. Premium Access, Fees, and PayFast Transactions

While FAIS Labs offers baseline training features, complete access to our full suite of balanced mock examinations requires a premium upgrade.

4. Digital Content Refund & Cancellation Policy

In accordance with Section 42(2)(f) of the South African Electronic Communications and Transactions Act (ECTA), the standard seven-day cooling-off period for cancellation does not apply to electronic digital content access if the service has begun with the consumer's consent.

• Immediate consumption: Because premium access activates instantly upon successful payment validation, all premium transactions are strictly non-refundable.
• Technical remediation: If a technical script error or hook failure delays your premium access activation, our support engineering team will manually restore and verify your entitlements upon receipt of a payment confirmation ticket sent to support@faislabs.co.za.

5. Intellectual Property Rights

The entire framework of FAIS Labs represents proprietary intellectual property.

• Content ownership: All text, question banks, explanations, dynamic task categorisation structures, custom database architectures, layout configurations, graphics, software code, and educational frameworks are the exclusive property of FAIS Labs.
• Limited user licence: Upon account creation or premium upgrade, FAIS Labs grants you a limited, non-exclusive, revocable, non-transferable licence to view and interact with our study questions strictly for your personal, non-commercial exam preparation.
• Explicit prohibitions: You are strictly forbidden from copying, reproducing, scraping, screenshotting, distributing, selling, or reverse-engineering our questions, mock papers, or interface structures. Any detected systematic content scraping will result in immediate account termination without refund and potential legal escalation.

6. Acceptable Use and Platform Protection

You agree to use FAIS Labs exclusively for its intended educational purpose. You are prohibited from:

• Using any automated bots, scripts, spiders, or scrapers to copy our testing datasets.
• Bypassing or attempting to manipulate our relational architecture, database loops, or webhook signature security verification channels.
• Intentionally introducing malware, viruses, or code vulnerabilities into our server runtime architecture.
• Using an empty catch block or security exploit to gain unauthorised administrative privileges (/admin access thresholds).

7. Limitation of Liability & Indemnity

• As-is baseline: The FAIS Labs application is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including warranties of merchantability, uptime reliability, or complete question accuracy.
• System vulnerabilities: While we take structural measures to secure our environment — including hashing passwords — we are not liable for any data exposures resulting from unauthorised third-party cross-site scripting (XSS) actions targetable at client-side browser storage formats.
• Limitation of damages: To the maximum extent permitted by South African law, FAIS Labs shall not be liable for any direct, indirect, incidental, consequential, or special damages, including lost revenue, failure to pass official regulatory assessments, or employment disruptions arising out of your use of the platform.

8. Service Modification & Termination

• Platform iterations: FAIS Labs reserves the right to update question terminology, adjust task distributions, patch system bugs, or modify dashboard features at any time without prior notice to align with updated financial legislation.
• Account revocation: We reserve the right to suspend or permanently terminate your account workspace access, without notice or refund, if we detect a breach of these Terms, including credential sharing, commercial exploitation, or system manipulation.

9. Data Protection and POPIA

Your personal data, educational answers, hesitation metrics, and security logs are handled in strict compliance with our Privacy Policy, which mirrors the operational mandates of the South African Protection of Personal Information Act (POPIA). By agreeing to these Terms, you acknowledge and consent to our secure data processing and storage procedures.

10. Governing Law and Jurisdiction

These Terms, your relationship with FAIS Labs, and any legal disputes or reconciliations arising out of your usage of the application are governed strictly by the laws of the Republic of South Africa. Any formal legal proceedings must be instituted exclusively within the appropriate courts located in South Africa.
